Studio rules and
Terms of use

Welcome to Studio Kiwi! 🥝

These terms are intended to ensure the smooth running of the studio and to guarantee a welcoming environment for everyone. They apply to all visitors, participants, and Studio Mates.

Each person acknowledges having read, understood, and agreed to comply with these rules. This document is subject to prior electronic signature for validation.

Studio Kiwi is a shared creative space. Everyone's place is built on respect and care for one another.

✨ 1. ACCESS & ELIGIBILITY

🔸 1.1. Studio Kiwi is a creative space intended for adults. All regular sessions, courses, and workshops are open to participants aged 18 and over.

🔸 1.2. Minors may participate only with prior agreement from Studio Kiwi and must be accompanied at all times by an adult participant, depending on their age. The accompanying adult is fully responsible for the minor and their actions, including in the event of breakage, damage, or inappropriate behaviour. An exemption to the +18 rule is the subject of a separate document, to be completed and signed by the responsible adult before the minor's first session.

🔸 1.3. Studio Kiwi may refuse access, suspend participation, or terminate it in the event of disruptive, disrespectful, dangerous behaviour, or serious or repeated non-compliance with these rules.

Except in an emergency or imperative safety situation, the participant concerned is notified in writing (notably by email) of the observed breach before any suspension or exclusion measure is taken.

The financial consequences of a suspension or exclusion are assessed according to the specific situation and the severity of the breach. The general rule is that no refund is due, except in exceptional circumstances as determined by Studio Kiwi.

✨ 2. SAFETY, SIGNAGE & CONDUCT

🔸 2.1. The studio features extensive signage (panels, labels, displays) relating to safety, waste sorting, tool use, restricted access zones, cleaning instructions, and firing rules. This signage is an integral part of these terms and is not decorative. Upon entering the workshop, each participant is deemed to have taken note of it and undertakes to comply with it.

Any breach, including non-compliance with the Studio's signage, may result in sanctions proportionate to the severity and circumstances of the facts.

Sanctions are preceded by a written warning and may notably take the form of a fine, a temporary or permanent exclusion from the Studio, with or without refund depending on the situation.

When a participant's conduct or negligence causes material damage or additional costs, the responsible participant may be required to compensate for the loss incurred.

🔸 2.2. Participants undertake to clean their tools and workspace before leaving, as well as any surface they may have soiled. They undertake to respect the shared equipment and facilities.

🔸 2.3. Sessions end at the time indicated on the booking or in the confirmation communication. Participants begin tidying up 20 to 30 minutes before the end of their session to ensure the studio is clean and that they leave on time. In the event of repeated overruns, Studio Kiwi may take proportionate measures, such as a financial penalty or a suspension of the possibility to book, after informing the participant concerned.

🔸 2.4. The studio and the entrance are non-smoking and vape-free spaces. Tobacco and vaping are permitted only in the courtyard, away from other participants as well as from neighbours' doors and windows.

🔸 2.5. Alcohol is permitted only during events or workshops expressly designated for this purpose (for example, Sip & Spin) and must be consumed in moderation.

🔸 2.6. Harassment, discrimination, or any aggressive behavior result in immediate exclusion and, when circumstances justify it, a ban with or without refund at the Studio's discretion.

✨ 3. CLAY, FIRING & STORAGE

🔸 3.1. Clay is provided on-site. Current rates are displayed or communicated by Studio Kiwi. For reference, as of the last update of these terms:

👉 Grey / mixed / yellow / red / anthracite: 2.50€/kg

👉 Black / speckled: 3.50€/kg

👉 Porcelain: 7€/kg

🔸 3.2. All pieces must be clearly signed before entering the kiln. Studio Kiwi cannot be held responsible in the event of loss of unsigned pieces.

🔸 3.3. Firing is included in the workshop fees within the limits specified for the activity concerned. For Studio Mate sessions and Trimestrial Courses, firing is charged at the current rate. As of the last update of these terms:

👉 Bisque: 0.05€/cube

👉 Glaze: 0.06€/cube

🔸 3.4. Ceramic firing involves inherent risks, notably related to the nature of materials, construction techniques, air bubbles, incompatibilities between clays and glazes, or unpredictable reactions during firing. Studio Kiwi cannot be held responsible for damage resulting from defects in the piece itself, inadequate construction, non-compliance with instructions, or risks inherent to the firing process.

🔸 3.5. Finished pieces must be collected within 3 months from the day after the publication of the end of firing of the piece on the Studio Kiwi blog. Studio Kiwi will send a reminder when the participant's contact details are available. If pieces are not collected after this period, the Studio may proceed to recycle, destroy, or take any measure necessary to free up storage space.

🔸 3.6. At the end of their Trimester as a participant or Studio Mate, participants collect all their belongings and vacate their storage space. Studio Kiwi may apply the same procedure as detailed above to items left on-site beyond the specified period.

🔸 3.7. Tracking of pieces in firing is carried out exclusively via the Studio Kiwi blog. Participants are invited to consult the blog regularly to know the progress of their pieces. No request by email, message, or telephone will be processed on this subject: the Studio will automatically refer to the blog.

🔸 3.8. Studio Kiwi endeavours to respect a firing turnaround of approximately ten (10) working days per batch. This timeframe is however indicative and depends notably on the quantity and volume of pieces awaiting firing, possible kiln breakdowns, the organisation of firings, or technical constraints. Studio Kiwi does not guarantee this timeframe and does not undertake to compensate in the event of overrun, whatever the cause. Participants with personal deadlines (gifts, markets, exhibitions, etc.) must anticipate and plan a sufficient margin so as not to place time pressure on the Studio Kiwi team.

🔸 3.9. Loading, firing, and unloading operations are carried out exclusively by the Studio Kiwi team.

✨ 4. KILN CARE & DAMAGE FEES

🔸 4.1. When damage to the kiln, kiln shelves, equipment, or other participants' pieces results from fault, negligence, non-compliance with instructions, or a technical error attributable to a participant, Studio Kiwi may claim compensation corresponding to the costs incurred.

The following indicative amounts may notably be applied:

👉 Glaze drop on a kiln shelf: 10€/drop

👉 Damaged kiln shelf requiring replacement: 80€

👉 Damage to another member's piece: double the firing volume of that piece

👉 Major kiln repair: actual cost

👉 Miscellaneous material damage (electricity, furniture, tools): actual replacement cost

When circumstances justify it, Studio Kiwi communicates to the participant concerned the elements allowing them to understand the origin and assessment of the damage.

🔸 4.2. If a piece is damaged by proven negligence on the part of the Studio Kiwi team, a firing credit equivalent to double the volume of the damaged piece is granted to the participant concerned.

🔸 4.3. If the origin of the damage cannot be clearly attributed to the participant or the Studio Kiwi team, a credit equivalent to the volume of the damaged piece is granted.

🔸 4.4. These credits are strictly reserved for the firing of future pieces and cannot give rise to a cash refund.

✨ 5. SECURITY DEPOSIT

🔸 5.1. A refundable deposit of 50€ is required from all participants in Trimestrial Courses and all Studio Mates before their first session.

🔸 5.2. The deposit is intended to guarantee the full settlement of all amounts due by the participant to Studio Kiwi at the end of the trimester or period concerned, whether for clay purchases, firing fees, reimbursement of material damage, or any other consumption or debt towards the studio.

🔸 5.3. The deposit remains intact and at a constant amount of 50€ throughout the duration of the trimester or period concerned. It is only used at the end of the trimester, after full settlement of the participant's account.

🔸 5.4. The deposit is returned to the participant within 15 days following the end of the trimester, subject to the cumulative fulfillment of the following conditions: full settlement of all amounts due (including clay, firings, any damage, and all consumption), return of the storage space empty and in good condition, as well as compliance with all applicable rules for the participant.

🔸 5.5. If the amount of sums due or damage attributable to the participant exceeds the amount of the deposit at the end of the trimester, the participant undertakes to settle the remaining balance within 15 days following the end of the trimester or period concerned.

✨ 6. PAYMENTS, BOOKINGS & CANCELLATIONS

🔸 6.1. All bookings must be paid in full before the start of the session or course, unless prior written agreement has been obtained.

🔸 6.2. For participants with an active account (Studio Mates, Residents, Participants in a Trimestrial Course): any outstanding balance exceeding 50€ must be settled immediately. Failing this, access to the studio may be suspended until the balance is fully settled.

🔸 6.3. Any outstanding balance equal to or less than 50€

must be paid in full at the end of each calendar month. Failing this, access to the studio may be suspended. The deposit will not be used to cover these monthly debts; it remains reserved for the final settlement of the account at the end of the trimester.

🔸 6.4. Cancellation conditions depend on the type of service booked:

👉 One-off workshops: see the specific cancellation policy for the workshop.

👉 Trimestrial Courses: see the Trimestrial Course Cancellation Policy.

👉 Studio Mate sessions: sessions are non-refundable and non-transferable. Unused sessions expire at the end of the paid trimester.

🔸 6.5. Studio Kiwi reserves the right to modify its rates upon renewal or registration for a new trimester. Active bookings are locked at the rate paid at the time of booking.

✨ 7. LIABILITY

🔸 7.1. Participation in pottery activities involves inherent risks related to the practice, notably linked to physical effort, the use of sharp tools, and the handling of hot equipment. By participating in Studio Kiwi activities, each participant acknowledges awareness of these risks and chooses to accept them.

🔸 7.2. Studio Kiwi is not a therapeutic or medical establishment. It does not provide mental health support or trauma care.

🔸 7.3. Studio Kiwi cannot be held responsible for cuts, burns, stains, or minor muscular discomfort resulting from the normal practice of the studio's activities.

🔸 7.4. Studio Kiwi cannot be held responsible for the theft, loss, or damage caused to personal effects brought into the studio.

🔸 7.5. Each participant is responsible for any damage caused to equipment, furniture, or studio property resulting from their negligence, non-compliance with instructions, or misuse.

✨ 8. IMAGE RIGHTS AND SOCIAL MEDIA

🔸 8.1. Upon enrolment or first booking, each participant indicates their choices regarding the taking, use, and distribution of their image in the electronic signature form. The following authorizations are collected separately:

👉 The authorization to be photographed or filmed during Studio Kiwi activities;
👉 The authorization to use and distribute these images for communication and promotional purposes, notably on the Studio Kiwi website, social media, and newsletters.

By ticking these boxes, the participant allows Studio Kiwi to document their creative journey: their pieces, their progress, their place within this community. This authorization allows the participant to keep a visible record of their work over time and to contribute to the collective story of the studio.

🔸 8.2. The participant may withdraw their consent to the taking, use, and distribution of their image at any time, by written request to info@studio-kiwi.com. The withdrawal is implemented within a reasonable timeframe from receipt of the request and applies to processing carried out after it takes effect, without calling into question the lawfulness of processing carried out prior to that date.

🔸 8.3. Participants are invited to share their work and their experience at the studio on social media. They are invited to tag @studiokiwibruxelles when they publish images taken inside the studio on Instagram.

🔸 8.4. Any participant publishing or distributing content that is manifestly false, defamatory, or misleading about Studio Kiwi may have their access to the studio suspended or revoked, without refund. Studio Kiwi also reserves the right to take any appropriate action to defend its rights and interests, notably in the event of defamation or denigration.

✨ 9. CHANGES TO THESE TERMS

🔸 9.1. Studio Kiwi may update these terms of use at any time. The version in force is always available on the Studio Kiwi website. Substantial changes are brought to the attention of the participants concerned before they take effect. Non-substantial changes take effect upon publication. Continued participation after the updated terms take effect constitutes acceptance of those terms.

✨ 10. COMMUNICATIONS AND CONTACT

🔸 10.1. Email (info@studio-kiwi.com) is the only official communication channel of Studio Kiwi for any question, information request, or procedure related to the studio. Messages sent via WhatsApp, Instagram, Facebook, or any other social network do not constitute a valid contact method. Studio Kiwi is not required to respond to them, and these messages cannot be invoked in the event of a dispute.

🔸 10.2. Tracking of pieces in firing is the subject of a dedicated procedure (see Article 3). On this subject, no request by email will be processed.

🔸 10.3. For any other question concerning these terms or Studio Kiwi activities, participants may contact Studio Kiwi at info@studio-kiwi.com.
